Welcome to Nonchi® Cashmere. Please read these Terms and Conditions ("Terms") carefully before accessing or using our website, services, products, collaborations, or engaging in any assignments, contracts, or services carried out for or on behalf of Nonchi Cashmere (collectively, the "Services"). By accessing or using our Services in any form, including but not limited to visiting our website, purchasing products, or collaborating as influencers, contractors, photographers, or other third parties, you agree to be bound by these Terms.

You represent and warrant that you:

• Agree that these Terms apply to all users of the Services, including but not limited to customers, collaborators, influencers, contractors, photographers, videographers, and other third parties who perform any work or service for or on behalf of Nonchi Cashmere.

• Acknowledge that these Terms govern all interactions, collaborations, contracts, and services with Nonchi Cashmere, whether intellectual or physical in nature.

2. Definitions

For the purposes of these Terms:

• "Nonchi Cashmere" / "Nonchi" / "Nonchi Amsterdam"  – refers to our company, brand, and all related entities.

• "Services" – includes use of the Nonchi Cashmere website, services, products, collaborations, and any assignments, contracts, or services carried out for or on behalf of Nonchi Cashmere, whether intellectual or physical in nature.

• "Collaborator" – includes influencers, photographers, videographers, contractors, consultants, and any other party working with or for Nonchi Cashmere.

• "Content" – includes text, images, designs, logos, audio, video, and any other material.

• "Website" – refers to www.nonchicashmere.com and any associated domains or platforms.

3. Eligibility

• You represent that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into these Terms.
• If you are under the age of majority, you may only use our services, purchase products, or enter into collaborations with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
• If you are acting on behalf of a company, organisation, or other entity, you confirm that you have full authority to bind that entity to these Terms.

4. Acceptance of Terms and Modifications

• By using our Services, you accept and agree to be bound by these Terms, as well as any other policies referenced herein, and;

• We reserve the right to modify these Terms at any time by posting updated versions on our website. Continued use of our Services after such changes constitutes acceptance of the new Terms, and;

• It is your responsibility to review the Terms periodically.

5. Intellectual Property Rights

All content on the Nonchi Cashmere website, including but not limited to text, images, videos, graphics, logos, and designs, are the exclusive property of Nonchi Cashmere or its licensors. You may not copy, reproduce, republish, upload, post, transmit, or distribute any content without our prior written consent.

6. Trademark

The “Nonchi®” name is a registered trademark, protected within the European Union under EUIPO registration. Nonchi Cashmere owns all rights to this trademark. Unauthorized use of the Nonchi® name or branding is strictly prohibited and may result in legal action.

7. Photography and Videography Usage

All photographs and videos created for or commissioned by Nonchi Cashmere (“Materials”) are exclusively intended for use by Nonchi Cashmere. The copyright (auteursrecht) remains with the creator, unless otherwise agreed in writing, but the following conditions apply without exception:

• Exclusive Usage Rights: Nonchi Cashmere retains the exclusive, unrestricted right to use, reproduce, publish, distribute, and edit the Materials in any format or medium, globally and in perpetuity.

• No Third-Party Use: The creator is strictly prohibited from transferring, licensing, selling, sharing, or otherwise making the Materials available to any third party — whether for payment, exposure, portfolio use, or free of charge — without explicit prior written approval from Nonchi Cashmere.

• No Alternative Publication: Any image or footage captured for Nonchi Cashmere — whether selected by Nonchi or not — may not be publicly released or published in any form (including portfolio, website, or social media), unless explicitly selected and approved by Nonchi Cashmere in writing.

• No Unauthorized Edits: No cropping, color adjustment, retouching, or creation of derivative works may be made to any Material — even by the original creator — without explicit written permission from Nonchi Cashmere.

• Brand Integrity & Traceability: All Materials must remain clearly attributable to Nonchi Cashmere. Any use by third parties (e.g. reposts or features) must include a clear credit to Nonchi Cashmere and may only be done with Nonchi Cashmere’s prior consent.

• Confidentiality: Behind-the-scenes content, unreleased footage, test shots, or unused images/videos may not be disclosed, previewed, or published by the creator or any involved party without written approval from Nonchi Cashmere.

• No Stock or Archive Use: Materials may not be added to any stock photography or video platforms, public databases, or commercial image banks.

• No AI Use or Training: The creator may not use the Materials for AI training, generative image platforms, or any machine-learning-based application.

• No Right of Credit: Nonchi Cashmere is under no obligation to credit the creator in any use of the Materials.

• Legal Enforcement: Any breach of this may result in legal action, including but not limited to financial compensation and removal of infringing content.

8. Third-Party Links and Services

• Our Services may contain links to third-party websites or tools that are not under our control, and;

• We are not responsible for the content, policies, or practices of any third-party websites or services, and;

• Use of third-party websites is at your own risk, and any disputes must be resolved directly with the relevant third party.

9. Accuracy, Completeness and Timeliness of Information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of these Terms for all purposes.
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

22. Entire Agreement

The Terms constitute the entire agreement between you and Nonchi Cashmere regarding your use of the Services, superseding any prior agreements between you and Nonchi Cashmere relating to your use of the Services.

23. Governing Law and Jurisdiction

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Netherlands.
You agree that any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in the Netherlands. 

24. Returns & Exchange

Please refer to our Refund Policy for details on returns and exchanges. We do not accept returns on worn, damaged, or custom-made items. Customers are responsible for ensuring accurate sizing before purchase; sizing guides are provided for reference.

25. User-Generated Content

By tagging Nonchi Cashmere in social media content or submitting content to us directly, you grant Nonchi Cashmere a non-exclusive, royalty-free, worldwide license to use, repost, share, or otherwise display such content on our platforms and marketing materials. If you do not wish for your content to be used, please contact us directly.

26. Third-Party Payment Services

If you choose to use third-party payment services, you are subject to their terms and conditions. Nonchi Cashmere is not responsible for any issues arising from third-party payment services.

27. Craftsmanship and Product Variation

All Nonchi Cashmere garments are crafted with the utmost care. Due to the nature of natural fibers and artisanal production, slight variations in color, texture, or sizing may occur and are not considered defects.

28. Force Majeure

Nonchi Cashmere shall not be held liable for any delay or failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, strikes, labor disputes, pandemics, government orders, or interruptions of internet or utility services.
